1. Introduction

Welcome to Immerska. By commissioning our services or using our website, you agree to these Terms of Service. Immerska provides premium 360° virtual tour services for real estate, hospitality, and other business sectors.

2. Definitions

• "Service" refers to our 360° virtual tour creation, photography, and related deliverables.
• "Client" refers to individuals or businesses who commission our services.
• "Virtual Tour" refers to the 360° interactive digital representations of physical spaces we create.
• "Content" refers to any material on our website including text, images, designs, and other materials.
• "Photographer" refers to Immerska or one of its agents, employees, or contractors who provide the Service.
• "Property" refers to any property (e.g., real estate, venue, building) in which the Client has commissioned the Photographer to photograph.

3. Service Provision

Immerska agrees to provide virtual tour services to clients according to the specifications agreed upon in writing or electronic communication. We reserve the right to refuse service at our discretion. Scheduling will be confirmed after booking and may be subject to change with reasonable notice.

4. Client Materials and Preparation

Clients are responsible for:

• Ensuring property access at the agreed time
• Obtaining necessary permissions from property owners or tenants
• Preparing spaces as recommended in our pre-shoot guidelines
• Informing us of any areas that should not be photographed

Immerska is not responsible for any delays or quality issues resulting from inadequate preparation or access limitations.

5. Property Access

Should Immerska be unable to access the property for any reason, the Client will be charged up to the full cost of the package booked plus any additional expenses incurred.

6. Property Preparation

The Client is solely responsible for preparing the property for photography. Immerska will photograph the property as presented. If Immerska is delayed by property preparation during the scheduled session, an additional fee may be charged for the extra time. Any additional visits required will be charged at our standard rate with a minimum charge of half the original package price.

7. Weather Contingencies

If adverse weather conditions impact a photo shoot, an additional visit may be required. Such additional visits may incur additional charges as agreed upon at the time.

8. Hosting of Virtual Tours

The hosting duration for 360° virtual tours is specified in your package description. Immerska uses third-party hosting services, and liability for hosting remains with those providers. Hosting extensions can be arranged for an additional fee prior to expiration of the initial period. Alternatively, tours may be transferred to client-owned hosting accounts upon request.

9. Cancellation Policy

Cancellations within 72 hours of the scheduled photography session will result in a charge of 100% of the agreed fee. Rescheduling requests with more than 72 hours' notice should be submitted via email. The Client is liable for any expenses incurred by Immerska due to rescheduling.

10. Portfolio and Marketing Usage

Unless explicitly requested otherwise in writing, clients grant Immerska permission to:

• Use completed virtual tours in our portfolio
• Share project examples on our website and social media
• Use client testimonials for marketing purposes
• Reference the client relationship in promotional materials

We respect our clients' privacy and will remove content from our portfolio upon request. Client confidentiality agreements can be arranged when required.

11. Intellectual Property Rights

All website content is owned by Immerska and protected by intellectual property laws. For commissioned virtual tours:

• Clients retain ownership of physical spaces captured
• Immerska retains ownership of the virtual tour itself, including all visual assets, coding, and implementation
• Clients receive a license to use and share the tour for agreed business purposes
• Unauthorized modification, distribution, or resale of our virtual tours is prohibited

12. Payment Terms

Fees are listed on our pricing page or in separate agreements. Payment is due upon completion unless specified otherwise. Due to the custom nature of our services, refunds are generally not provided unless deliverables substantially fail to meet agreed specifications.

For projects requiring multiple shooting days or extensive production, we may request a deposit before commencing work.

Full payment is required within 30 days. Where invoices have been issued, late payments will incur a late fee of €25 per week until full payment is received.

13. Limitation of Liability

Our services are provided "as is" without warranties of any kind. To the maximum extent permitted by law, Immerska shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid by you for the specific services in question.

We make every effort to create high-quality virtual tours, but cannot guarantee specific business outcomes (such as increased property sales or bookings) resulting from our services.

Immerska maintains comprehensive public liability insurance coverage for all photography sessions and related activities.

• Avoiding capturing people in tours
• Providing guidance on preparing spaces before photography
• Following client instructions regarding restricted areas

We offer access control options including password protection, time-limited access, and restricted viewing permissions.

4. Data Security

We implement reasonable security measures to protect your information. Client files and virtual tours are stored securely and backed up regularly. While we take precautions to safeguard your information, no internet transmission is completely secure.

5. Data Retention

We retain client information and completed virtual tours for the duration of our business relationship and for a reasonable period thereafter. Project files are typically kept for one year after delivery, unless otherwise specified.
